Thank you for your interest in Quovi™ ("Quovi," "we," "us," or "our"). Your privacy is important to us, and this Privacy Policy ("Policy") explains how we collect, use, disclose, and otherwise process personal information when you interact with our websites and our mobile application or related services (collectively, the "Services"). Please also review our Terms of Service (link placeholder), which set out the terms governing your use of the Services.

We only provide our Services to users in the United States and distribute our mobile application through Apple's App Store. While we respect global privacy principles, certain provisions in this Policy specifically address U.S. privacy requirements.

By using or accessing our Services, or by providing personal information to us, you agree to the practices described in this Policy. If you do not agree with these practices, please discontinue use of the Services.

1. Introduction

Quovi is an AI-powered fitness and wellness platform that provides coaching recommendations, workout plans, and related features to help users achieve their personal goals. We do not offer medical advice, and our Services are intended for general wellness only.

Quovi is not a Covered Entity or Business Associate under the Health Insurance Portability and Accountability Act (HIPAA); therefore, HIPAA typically does not apply to the data we collect. However, we recognize that certain health or fitness metrics may be sensitive, and we apply heightened security and privacy safeguards as described in this Policy.

If you choose to connect Quovi with third-party services (such as Garmin), please review their privacy practices. Your use of Garmin's APIs or data-sharing features is also subject to Garmin's own terms and privacy policies.


2. Information We Collect

We collect information about you, including information that directly or indirectly identifies you, as described below.

A. Information You Provide Directly

  1. Account & Profile Information
    • When you sign up for our Services or join our waitlist, we may request your name, email address, and a password (if applicable).
    • You may also provide optional demographic details (e.g., gender, age) to help personalize your fitness experience.
    • Certain features may prompt you to share height, weight, or other details relevant to workout or nutrition plans.
  2. Communication & Support
    • We collect any information you provide when you contact us (e.g., feedback, inquiries) or participate in surveys, promotional campaigns, or beta tests.

B. Information We Collect Automatically

  1. Log Data
    • Our servers automatically record information such as your IP address, device type, browser type, operating system, referring URLs, and the pages you visit in our app or on our site.
  2. Cookies & Similar Technologies
    • We may use cookies, web beacons, or similar tracking technologies to analyze usage, customize user experiences, and improve our Services. You can usually control cookies via your browser settings, though disabling them may limit some functionality.

C. Information from Third Parties

  1. Garmin & Other Wearables
    • If you choose to connect your Garmin account (or other wearables in the future), we collect activity metrics (e.g., distance, pace, heart rate, steps, courses, training schedules) or other relevant data (e.g., stress levels, women's health data), only after you explicitly grant us permission through Garmin's OAuth or similar process.
    • You can revoke this permission at any time (see Garmin Activity Data & Integrations).
  2. AI Vendors & Analytics
    • We may partner with service providers who process certain user data on our behalf (e.g., AI-based analytics or cloud hosting). They collect information under our instructions, consistent with this Policy and subject to confidentiality obligations.
  3. Social Media or Third-Party Accounts
    • If you integrate social media or other third-party accounts with Quovi (for login or sharing activities), we may receive the information those services provide based on your settings.

3. Garmin Activity Data & Integrations

A. What We Collect from Garmin

When you connect your Garmin account, we may access various activity, health, or training data, including but not limited to:

  • Activity Metrics: Distance, pace, cadence, step count, elevation
  • Health Metrics: Heart rate, VO2 max, sleep, stress levels, women's health tracking, and other biometric data
  • Training & Courses: Training plans, course routes, progress stats

You must affirmatively grant permission for Quovi to receive this data via Garmin's OAuth process. If you do not grant access, we will not receive or process your Garmin data.

B. How We Use Garmin Data

  • Personalized Coaching: Generate or adapt workout plans based on real-time performance and historical trends.
  • Progress & Analytics: Display your fitness history, provide insights, and allow you to track improvements over time.
  • Service Improvements: Improve and refine our AI models in a manner that prioritizes aggregated or de-identified data, wherever feasible.

C. Disclosure of Garmin Data

We do not sell your Garmin data for marketing purposes. We only share Garmin data in these limited circumstances:

  1. Service Providers
    • With trusted vendors (e.g., AI processing, cloud hosting) who store or analyze data on our behalf, bound by contractual obligations to protect confidentiality and use data solely for Quovi's Services.
  2. Business Transfers
    • If Quovi merges, is acquired, or sells assets, your data may be transferred as part of that transaction provided that the acquiring entity agrees to honor the commitments in this Policy. If the new entity intends to use your data in a materially different way, we will notify you and request consent where required.
  3. Legal Obligations
    • If required by law or to respond to a valid legal process, or where we believe disclosure is necessary to protect our rights or the safety of others.

D. Revoking Access

You can revoke Quovi's access to Garmin data at any time by:

  • In-App Controls: Disconnect your Garmin account in your Quovi account settings.
  • Garmin Settings: Adjust permissions directly in your Garmin Connect or related Garmin portal.

Once revoked, we will not receive new data from Garmin. You may also request deletion of previously collected Garmin data (see Data Retention & Deletion).


4. How We Use Your Information

We use the information we collect for purposes such as:

  1. Providing the Services
    • Personalizing workout plans, training schedules, and nutritional guidance
    • Displaying progress dashboards and analytics
  2. AI Features & Analytics
    • We apply machine learning and other AI techniques to deliver personalized insights. Wherever possible, we use aggregated or de-identified data to protect your privacy.
  3. Communications
    • Sending you updates about features, product launches, and marketing messages (where permitted by law).
    • Responding to inquiries and support requests.
  4. Site & Service Improvements
    • Debugging and troubleshooting
    • Monitoring usage trends to enhance performance and user experience
  5. Legal, Security & Fraud Prevention
    • Protecting our rights, property, and users
    • Complying with legal obligations and enforcing our Terms of Service

5. How We Share Your Information

We do not sell your personal information for monetary consideration or for targeted advertising. We may share your information under these limited circumstances:

  1. Service Providers
    • With trusted third parties that assist us in hosting, analytics, AI model processing, or operational tasks. They may only access your data as necessary to perform their services and are contractually required to protect it.
  2. Business Transfers
    • If Quovi is involved in a merger, acquisition, reorganization, or asset sale, your personal information may be transferred. We require the acquiring entity to adhere to the commitments in this Policy or notify you if data will be used differently.
  3. With Your Consent
    • If you specifically request or direct us to share information (e.g., posting workout achievements to social media).
  4. Legal Requirements
    • If required to comply with the law, regulation, or valid legal process, or to protect Quovi's rights or the safety of others.
  5. Aggregated or De-Identified Data
    • We may share aggregated or anonymized statistics (e.g., average daily steps of our users) that do not identify any individual.

6. Data Retention & Deletion

We retain your personal information only as long as necessary for the purposes described in this Policy or as required by law. Specifically:

  • Garmin Data: We typically store your Garmin activity data while your account is active and for a reasonable period (e.g., up to 12 months) after you disconnect Garmin or delete your account, unless a longer retention is necessary for legal or legitimate business reasons.
  • Account Data: Maintained while your account remains active or as needed to provide our Services.
  • Deletion Requests: You can request deletion of your personal data or account by emailing privacy@quovi.app. We will make reasonable efforts to remove your data promptly from active systems and backups within a specified timeframe (e.g., 30–60 days), unless legally required to retain it.

Once data has been aggregated or de-identified for analytics or AI model improvements, we cannot always guarantee removal of previously derived insights, but we ensure it is not identifiable to you.


7. Sensitive Health & Fitness Data

Certain metrics we collect from Garmin or that you provide (e.g., heart rate, sleep data, stress levels) can be considered sensitive personal information under some privacy laws. By connecting your Garmin device or providing this information, you expressly consent to our processing of such data for:

  • Personalized fitness/wellness insights (e.g., customized workout plans)
  • Analytics to improve user experience (aggregated or de-identified where feasible)

We will not use or disclose sensitive health/fitness data for purposes unrelated to your user experience, nor will we sell or license it to third parties for marketing. If you wish to withhold or revoke consent for sensitive data processing, you may do so at any time by disconnecting Garmin or adjusting your account settings (though certain features may be limited if we do not have this data).


8. Your Rights & Privacy Controls

  1. Access & Portability
    • You may request a copy of the personal information we hold about you. Contact us at privacy@quovi.app.
  2. Rectification
    • You can update or correct certain personal information in your account settings or by emailing us.
  3. Revoking Garmin Access
    • As explained above, you can disconnect your Garmin account or revoke permissions at any time within your Quovi profile or Garmin account.
  4. Deletion
    • You can request deletion of your account or personal data at privacy@quovi.app. We will remove your personal information unless we need to retain it for legal or legitimate business reasons.
  5. Marketing Preferences
    • You can unsubscribe from marketing emails by clicking the "unsubscribe" link or adjusting your communication preferences.

Depending on your U.S. state of residence (e.g., California), you may have additional privacy rights (see Additional Notice for California Residents).


9. Additional Notice for California Residents

If you are a California resident, you may have certain rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including:

  • Right to Know/Access: The categories and specific pieces of personal information we have collected about you, the sources, and how we share it.
  • Right to Delete: You may request that we delete personal information we have collected, subject to certain exceptions.
  • Right to Correct: You may request that we correct any inaccurate personal information.
  • Right to Opt Out of Sale/Sharing: We do not sell your personal information for monetary consideration or share it for cross-context behavioral advertising.
  • Non-Discrimination: We will not discriminate against you for exercising these rights.

To exercise your California privacy rights, contact us at privacy@quovi.app. We may need to verify your identity (e.g., email confirmation). We aim to respond to verified requests within 45 days, unless we need an extension, in which case we will notify you.

Minors in California: If you are a registered user under the age of 18 and a California resident, you may request removal of content or information you have posted by contacting us. We will make reasonable efforts to remove such content upon valid request. Note that removal may not be comprehensive if the content has been shared or reposted by others.


10. Security Measures

We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, loss, misuse, or alteration. These measures include:

  • Encryption in transit and at rest for sensitive Garmin metrics and AI-generated insights
  • Access Controls that limit who can access your data within our organization and among service providers

No method of data transmission or storage is entirely secure; thus, we cannot guarantee absolute security. If you suspect any security breach, please contact us immediately at privacy@quovi.app.


11. Children's Privacy

Our Services are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If you are under 13, do not attempt to register for or use the Services.

If we learn that we have inadvertently collected personal information from a child under 13, we will promptly delete that data. If you believe we may have such information, please contact us at privacy@quovi.app.

Users Aged 13–17: You may use the Services only if you are at least 13 years old. By creating an account, you represent and warrant that you are at least 13. If you are between 13 and 18, we encourage you to involve your parent or legal guardian in reviewing this Policy. Quovi does not require parental consent for users aged 13–17, but certain state laws or app features may limit functionality for minors. 12. U.S.-Only Service & Data Transfers

We currently operate in the United States. If you access or use the Services from outside the U.S., you acknowledge that we process your personal information in the U.S., where data protection laws may differ from those in your country of residence. We do not actively market or provide our Services to users outside the U.S.


13. Changes to This Privacy Policy

We may update this Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. When we do, we'll post the revised Policy with a new "Effective Date" at the top. If the changes are significant, we'll provide more prominent notice (e.g., an email or an in-app notification). Continued use of our Services after any update constitutes your acceptance of the revised Policy.
